St John Villa Terms & Conditions of Rental

This Rental Agreement/Invoice becomes a binding agreement upon receipt of your deposit. Contained herein are the terms and conditions regarding this rental between you, the "Guest", and Jereli Real Estate, LLC, the owner of Kismet. Your remittance of payment in response to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations, and restrictions as printed below. If you have any questions regarding the following, please contact us before sending your rental deposit.

PAYMENT POLICY: Your booking will be confirmed upon receipt of payment deposit consisting of one-half of the total of rental. Payment is due within 10 days of booking. Failure to make this payment subjects your reservation to automatic cancellation without notice to you. The balance due of rent, 10% Government Hotel Tax, and damage deposit must be paid in full at least 45 days prior to your arrival. Payment by check is preferred but Kismet also accepts Visa and MasterCard.

CANCELLATION POLICY: All cancellations, date changes, or changes in the number of persons must be made IN WRITING. If you cancel more than 60 days prior to your arrival date, you will be refunded 80% of your total rent. The remaining 20% will be retained by Kismet as full-liquidated damages. If you cancel within 60 days of your arrival date, Kismet will retain 100% of your total rent as full liquidated damages. However, if another guest rebooks your cancelled dates, 80% of your total rent will be reimbursed for the nights rebooked. The remaining 20% will be retained by Kismet as full-liquidated damages.

DAMAGE DEPOSIT: Damage deposit of $1,500 is required to cover any damage, breakage, missing items, additional cleaning if villa is left abnormally dirty, long-distance calls charged to Kismet's telephone, and/or any other charges incurred before, during or after your stay, still outstanding. This damage deposit is refundable within 45 to 60 days of your departure. All normal utilities (except for long-distance phone calls or careless or extremely excessive use of Kismet's water supply) are included in your rental costs. You hereby agree to pay Kismet the cleaning or replacement costs for all damages to personal property or to the real estate, which may occur because of your occupancy, excluding normal wear and tear. Locked pantries, closets, and rooms reserved for Kismet's owners are not included in this rental. You, as the Guest, agree to take all reasonable steps to ensure that your family and other guests in your party adhere to the rules and regulations affecting your stay at Kismet. Rearranging furniture or removing any items from Kismet is prohibited.

The damage deposit for Social Events is an additional $3,000 over the base damage deposit of $1,500 to address Villa clean-up and damage issues. The damage deposit may be utilized by Kismet, if necessary, for such follow-up maintenance as complete cleaning of and removal of refuse from the Villa and necessary septic system pump-out, as well as to reimburse the cost of repair/replacement of any actual damage to Kismet or its furnishings. Guests planning social events should expect that such costs, if incurred, may consume material amounts of their damage deposit. Receipts as well as a list of expenses applied to the damage deposit will be furnished upon a Guest's request.

OUTSIDE CHARGES WITH KISMET: Transportation: If any renter, or one of the renter's party, needs water taxi and/or land taxi service that is not covered by Kismet package, the renter or renter's party is advised to use their own credit card to pay for such services in advance prior to their arrival and departure. Wheatley Taxi and Per Dohm will then provide pre-paid vouchers to the party. Charges to Kismet's Accounts: If persons want to charge transportation or anything else to Kismet, it is preferred that payment be submitted by check or cash upon arrival at Kismet or such will be deducted from the prime renter's security deposit upon departure; and only remitted by Kismet to the prime renter when payment is received. If there is no choice but for the guest to use a credit card to reimburse Kismet, then the amount will be withheld from the prime renter's security deposit until payment has been received by Kismet. If any such charge should occur, the person(s) should be aware of this policy in advance and such person must sign either an IOU, or a Kismet Agreement and Authorization to Use Credit Card. Awareness of Bill: All person(s) using a credit card should be aware that their credit card statement would indicate: Jereli Real Estate, LLC.

LIABILITY: Kismet assumes no liability for injury, accidents, delay, or irregularity, which may be occasioned by either reason or defect in any vehicle, or the acts of any company or persons engaged in conveying passengers to or from the villa. Providers who operate independently of Kismet, even if arranged and/or paid by Kismet, (water taxis, rental cars, taxis, ferries, and charter vessels) supply transportation. We assume no responsibility, therefore, for any loss, injury, or damage to person or property because of the acts of those providers. Furthermore, the Guest is responsible for Kismet during occupancy, must lock the windows, doors, and gates securely at all times when not on the premises, and must exercise care in securing all personal property. Guests must observe all cautions as given in our Guest Guide and/or by the Estate Managers. Kismet's owners reserve the right to refuse service or rentals to anyone at their complete discretion.

NO PETS: Pets are NOT allowed in Kismet without specific written approval from the owners granted prior to your arrival. A pet or evidence of a pet found on the premises may lead to eviction and forfeiture of Guest's rent and deposit.

COMPLAINTS AND MAINTENANCE: Kismet's staff will make every effort to keep the villa and its inventory in good working order. In case of a maintenance problem, they will strive to repair the problem as soon as possible after notification. However, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, telephone service, water, pool filtration systems, hot tubs, air conditioning, television or satellite service, appliances, etc. It is the Guest's obligation to report any problems or damage to Kismet's Estate Managers regardless of the hour.

CHECK-IN and CHECKOUT TIMES: Guests must vacate the villa no later than 10 am. Check-in time is 3 pm. Guest may incur a $250 penalty charge for failing to check out by 10 a.m. sharp. Check-in and checkout times are strictly enforced. If you would like a later checkout time, you are required to check with our Estate Managers during your stay to see if another group is arriving the day you leave. If not, you might be able to stay on later into the afternoon at no charge, but you are required to get prior permission to stay later than the published checkout time.

ENTRY INTO KISMET: Kismet's Estate Managers and subcontracted staff may enter your villa to perform any repairs as necessary. Scheduled maintenance services and housekeeping hours are listed in our Guide

DRUGS AND HAZARDOUS MATERIALS: The use and/or the possession of any illegal substances, inflammable fluids or other explosives or articles deemed hazardous to life, limb, or property is strictly prohibited at Kismet. Any evidence of such will result in immediate eviction and forfeiture of entire rental payment.

KISMET KEYS: Guest will be charged $25 for each set of lost or mishandled keys. You are required to follow instructions on where to leave the villa keys when you depart.

CAPACITY OF KISMET: The total number of persons allowed in the villa at any one time is restricted to the number of persons scheduled and paid for, based on two persons per bedroom and, possibly, billiard room. Should a group misrepresent themselves, they will be required to pay for all excess persons immediately, or shall vacate the villa without refund. Exceptions are made only for infants less than 2 years of age if sleeping in a baby crib and not occupying one of the villa's beds.

SOCIAL EVENTS : Guests at Kismet may host social events as do the Owners. Kismet is one of the prime places chosen for rental and for Guests hosting social events on St. John because of the site, the views, the sunset and sunrise, the ambiance of the villa itself, and the number of persons it can accommodate. Because Kismet is in a residential neighborhood, every effort must be made to reduce noise and impact on Kismet's neighbors. Those guests wishing to host a wedding or other reception should note that the Rules and Regulations listed below or on the Social Events page must be adhered to.

Absolutely NO house parties or functions over 20 persons are allowed unless planned in advance with Kismet approval and appropriate Damage Deposit. If a Guest is found to have had any sort of group gathering for more persons than officially scheduled at the villa without Kismet's advance written permission, he/she is subject to forfeit the entire villa damage deposit, at Owner's discretion.


If you host such an event, the following Rules and Regulations must be observed :

  1. All Social Events must be planned and booked in advance so that the Kismet staff is aware and ready for such Event and so that appropriate Damage Deposits are paid in advance. Absolutely no receptions or house parties are allowed without such advance notice and written Kismet permission. If any Guest is found to have had any sort of group gathering for more than twenty persons other than that planned and officially scheduled with Kismet's advance written permission, that Guest will be subject to forfeiture of his entire Security Deposit.
  2. In an effort to reduce noise and discomfort for the neighbors and to reduce wear and tear to the villa, Kismet will accommodate no more than 60 persons at any event. Maximum overnight occupancy by no more than 12 persons must be observed.
  3. If a band is hired for any social event, the band must have only acoustic instruments. Electronic instruments, outdoor speakers and amplifiers are prohibited.
  4. All music must end by 9:30 PM.
  5. Kismet kindly requests also that efforts be made to reduce any other loud outdoor noise after 9:30 PM, including extremely noisy conversation.
  6. The social event reception itself, with any gathering of non-Kismet guests, must end by 10 PM.
  7. All traffic coming and going from Kismet should make an extra effort not to disturb neighbors. No cars or taxis should park in, nor turn in, any neighbor's driveway.

Planned Social Events require a larger Security Deposit than rentals without such. Please read above under Damage Deposit for further understanding of use of Security Deposit with planned Social Events.

Weddings and any other social events are totally the decision of, and the responsibility of, the renter, and if involved, their event planner. Kismet itself is not in the business of planning, creating or executing such Social Events.

RATES AND PRINTING ERRORS: The information contained in Kismet's web site is constantly updated. Rates are subject to change without prior notice.

If any dispute arises out of this rental agreement, the laws of the United States Virgin Islands shall apply and the prevailing party shall recover its costs, expenses, and reasonable attorney's fees. This Rental Agreement becomes binding when you send us your rental deposit. Your sending payment in response to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations, and restrictions as printed above.
